Apply for a Florida or Federal Pardon/Clemency
Eligibility for Florida executive clemency: The Governor of Florida, with the approval of at least two cabinet members can issue a commutation of your sentence at any time, for any reason. A commutation will reduce your sentence, but does not restore your civil rights or your gun rights. The Governor of Florida can deny clemency for any reason. To start the process, you must seek a waiver to apply for clemency. To be eligible for commutation in Florida, you must wait until two years after conviction. If serving a mandatory minimum sentence, you must serve 1/3 of the sentence before you can apply.

Applying for a Federal Pardon
Section 1.3 of the Rules Governing Petitions for Executive Clemency reads “No petition for commutation of sentence, including remission of fine, should be filed if other forms of judicial or administrative relief are available, except upon a showing of exceptional circumstances.” Pardon Requests usually are not accepted from persons challenging their sentence or conviction through appeals courts or other court proceedings.
